Seller identification
The itineraries offered on etaperia.com are sold by Kylian Surget, sole trader under the French micro-entreprise regime, SIRET 927 587 709 00035, registered office 6 rue d'Armaillé, 75017 Paris, France, email contact@etaperia.com. VAT not applicable, article 293 B of the French General Tax Code.
The seller is referred to below as "the seller". Any natural person who purchases on the site outside of their professional activity is referred to below as "the customer".
Article 1 - Purpose and acceptance
These terms and conditions of sale govern the sale of the digital content offered on the site, to the exclusion of any other terms.
The customer declares that they have read and accepted them before confirming their order. This acceptance is a condition of the order.
The applicable terms are those in force on the date of the order. The seller may modify them at any time, with no effect on orders already placed.
Article 2 - Nature of the products
The seller sells travel itineraries as digital content, made available in the site's customer account: each itinerary can be read online there and downloaded in PDF format. It describes a day-by-day programme, with the places to visit, named hotels and logistical pointers.
The essential characteristics of each product, its duration, its format, its number of pages, its price and its last-updated date appear on its product page before the order.
The seller is neither a travel agency nor a travel or holiday operator within the meaning of articles L211-1 et seq. of the French Tourism Code. It does not sell, book or organise any transport, accommodation or activity service, collects no money in that respect, and acts as an intermediary for no tourism provider. The products sold are information and preparation documents. All bookings remain made by the customer, under their sole responsibility, directly with the providers concerned.
Article 3 - System requirements and interoperability
Accessing the customer account, reading online and downloading require a recent web browser and an internet connection, on a computer, tablet or phone. Reading the downloaded PDF requires software able to open this format; once downloaded, the PDF can be read offline, only opening the links it contains requires a connection. No other specific hardware or software is required.
The files carry no technical protection measure restricting their reading, printing or private copying.
Article 4 - Prices
Prices are shown in euros and include all taxes. VAT not applicable, article 293 B of the French General Tax Code. The price of each product appears on its page.
The seller may change its prices at any time. The applicable price is the one displayed at the time the order is confirmed.
Article 5 - Ordering
The order follows these steps: selection of the itinerary, review of the summary and the price, acceptance of these terms and express waiver of the right of withdrawal, then payment.
Validation of the payment forms the contract of sale. A payment confirmation email, with the order summary, is sent to the address provided at checkout. That address is the one that unlocks access to the itinerary in the customer account: it is the customer's responsibility to provide a valid email address.
The seller may refuse an order in the event of a previous payment dispute, suspected fraud or a clear breach of article 8.
Article 6 - Payment
Payment is made online, in full, by bank card, through the payment provider Stripe. The seller has access to no bank card data and stores none: this data is processed directly by the payment provider on its secure page.
The order is only processed once the payment has actually been received.
Article 7 - Delivery
The itinerary is made available electronically in the site's customer account, immediately after payment confirmation and in any event within twenty-four hours. No delivery is made by email.
The customer accesses their itinerary by signing in to the customer account with the email address used at payment. They can then read it online and download its PDF, with no limit on the number of downloads, for as long as their account exists.
In the event of access difficulties, the customer contacts the seller at contact@etaperia.com. The itinerary is made available again free of charge.
Article 8 - Right of withdrawal
The itinerary is digital content not supplied on a physical medium, whose performance begins immediately after payment.
In accordance with article L221-28 13° of the French Consumer Code, the customer gives their prior express consent to this immediate performance and expressly waives their fourteen-day right of withdrawal, by means of a non-pre-ticked checkbox presented before payment. The right of withdrawal is lost as soon as the file is made available.
Without this box ticked, the order cannot be confirmed.
Article 9 - Licence of use and intellectual property
The purchase grants the customer a personal, private, non-exclusive and non-transferable licence of use on the delivered file. The customer may read it, print it and use it for their own trips.
The following are prohibited: resale, public availability or availability for download, sharing with third parties, distribution on a network or shared storage space, and any commercial exploitation, even partial, of the content.
Article 10 - Legal warranty of conformity
The customer benefits from the legal warranty of conformity for digital content provided for in articles L224-25-12 et seq. of the French Consumer Code. Non-conforming content, in particular an unreadable or incomplete file or one that does not match the description on its product page, is brought into conformity free of charge and within a reasonable time after being reported to contact@etaperia.com.
If bringing it into conformity is impossible, the customer may obtain a price reduction or the termination of the contract under the conditions provided for by those articles.
Article 11 - Liability
The itinerary is an information and preparation document. It is neither a booking, nor a guarantee of availability, nor personalised advice on safety, health or administrative formalities.
The seller is bound by a best-efforts obligation as to the accuracy of the information at the last-updated date shown on the product page. It cannot be held responsible for closures, changes in opening hours or prices, cancellations, accommodation unavailability, weather conditions, administrative decisions, or events occurring during the trip. This paragraph applies subject to the commercial guarantee of article 12.
It is the customer's responsibility to check before departure the opening hours, prices, access conditions, entry formalities, health recommendations and safety guidelines in force, and to take out the insurance they deem necessary.
The seller cannot be held liable in the event of force majeure. In any event, it is limited to the amount paid by the customer for the itinerary concerned.
Article 12 - Itinerary updates and commercial guarantee
Each itinerary shows its last-updated date. The seller corrects information reported to it that has become inaccurate; the corrected version replaces the previous one in the customer account free of charge.
Commercial guarantee "corrected within 7 days, or refunded": the seller, identified at the top of these terms, grants it free of charge to the customer, whatever their country of residence, on each itinerary purchased from its product page, including the stages unlocked by a complete itinerary. It may be invoked for twelve months from the order date. Tailor-made itineraries under article 19 are not covered.
Covered cases: on the date of the report, either a hotel or other accommodation shown for a night of the programme is closed, meaning it no longer takes guests, or can no longer be found, meaning it no longer exists at the address given or can no longer be booked, for any date and by any means; or a place to visit named in the day-by-day programme is closed to the public permanently or with no announced reopening date.
Excluded cases: accommodation that is fully booked or unavailable on the dates chosen by the customer; a seasonal or weekly closure; a one-off closure due to an event (weather conditions, natural disaster, strike, temporary administrative decision); a change in opening hours, prices, access conditions, name or operator; an inactive booking link while the establishment can still be booked; restaurants, cafés and shops; a closure already corrected in the version of the itinerary available in the customer account at the time of the report. These cases fall under the first paragraph.
How to invoke it: the customer writes to contact@etaperia.com stating the itinerary and the name of the hotel or place; no other formality or evidence is required. Within seven calendar days of receiving this message, the seller makes available in the customer account a corrected version of the itinerary, and of any other itinerary of the customer containing the same information, in the language stated by the customer or, failing that, in the language of their message, then informs the customer by email. Each hotel or place reported opens its own period.
Content of the correction: the hotel is replaced by an establishment that is trading and open for booking on the date of the correction, located on the route of the stage or nearby and, as far as possible, of a comparable category, with any adjustment to the programme that this replacement requires; the closed place is removed from the programme or replaced by another visit. The availability of the replacement establishment on the customer's dates is not guaranteed.
Refund: if no corrected version is made available within this period, the seller refunds the customer, with no further step on their part, the full price paid for the itinerary purchased, meaning the price of the complete itinerary when that is what was purchased, to the payment method used and within fourteen days of the end of the period. The refund is due only once per itinerary; access to the refunded itinerary is kept, without any further use of the guarantee.
If the report does not fall within the covered cases, the seller informs the customer by email, with reasons, within the same seven-day period; the customer retains the remedies of articles 15 and 16. This guarantee is in addition to the legal warranty of conformity of article 10, which applies independently of it, and does not deprive the customer of any right they hold under the law. It does not restore the right of withdrawal waived under article 8. Refund of the price is the only benefit due under this guarantee: it does not cover the travel, transport, booking or accommodation costs incurred by the customer.
Article 13 - Affiliate links
As of today, no hotel booking link contained in the itineraries is an affiliate link: the seller earns no commission on the customer's bookings. If an affiliate programme is joined, the links concerned will be flagged and this article updated. Hotels are chosen for their relevance to the itinerary, regardless of the existence of an affiliate programme.
Article 14 - Personal data
The data collected as part of the order is processed in accordance with the site's privacy policy, available from the footer.
Article 15 - Customer service and complaints
Any question or complaint should be sent to contact@etaperia.com. A reply is provided within forty-eight working hours.
Article 16 - Consumer mediation
After a written complaint sent to customer service and left unresolved, the consumer customer may refer the matter free of charge to the consumer mediator whose contact details appear in the legal notice, in accordance with articles L616-1 and R616-1 of the French Consumer Code.
Article 17 - Evidence and archiving
The records of the seller and those of its payment provider, kept under reasonable security conditions, constitute proof of orders and payments. The terms accepted at the time of the order are archived and provided to the customer on request.
Article 18 - Severability and non-waiver
If a provision of these terms is declared void or unenforceable, the other provisions retain their full effect.
The seller's failure to rely on a provision does not constitute a waiver of its right to rely on it later.
Article 19 - Tailor-made itineraries
The seller also designs tailor-made itineraries, based on the request the customer sends by email to contact@etaperia.com (country, duration, dates, constraints). These terms apply to that service, subject to the clarifications of this article.
Quote: the seller sends the customer, by email, a quote stating the content of the itinerary, the number of days, the price and the indicative delivery time. The order becomes firm when the customer accepts this quote in writing, by return email. Any change requested after acceptance (country, duration, dates) gives rise to a new quote.
Payment: the price is paid in full before work begins, under the terms of article 6. The delivery time runs from receipt of payment.
Delivery: the itinerary is made available in the customer account, at the email address used for payment, under the conditions of article 7 and within the indicative time agreed in the quote.
Right of withdrawal: the tailor-made itinerary is digital content not supplied on a physical medium, whose performance begins upon receipt of payment. In accordance with article L221-28 13° of the French Consumer Code, the customer gives in writing, before payment and together with the acceptance of the quote, their prior express consent to this immediate performance and expressly waives their fourteen-day right of withdrawal. Without this written waiver, work does not begin.
Warranty: the tailor-made itinerary is covered by the legal warranty of conformity of article 10, assessed against the accepted quote.
Article 20 - Governing law and disputes
These terms are governed by French law. Failing an amicable resolution, any dispute falls under the jurisdiction of the competent courts according to the ordinary rules of law. This English version is a courtesy translation of the French "Conditions générales de vente": in the event of any discrepancy, the French version prevails.
